Workshop Policies/ Terms and Conditions:

💫 All purchases are non-refundable and cannot be returned after purchase has been made, whether paid in full or via monthly payment plan.

💫 Cancelation by Attendee: I understand that things happen and if you are unable to attend the workshop under your own circumstances after purchasing the ticket, you will not receive a cash/credit refund. (I may be able to provide a DIY Home Kit depending on the circumstances. TBD on a case-by-case basis.)

💫 Cancelation by Banana Leaf LLC: If, for any reason, the Halloween Tumbler Workshop must be canceled by Banana Leaf LLC due to unforeseen circumstances beyond my control, DIY Home Kits will be fulfilled as soon as possible.

 

💫 Photos will be taken during the workshop. By purchasing this listing, you approve that photos may be taken of you and be posted on social media for the use of marketing or advertising purposes only.

💫 Cups may contain minor imperfections due to them being hand crafted.

Banana Leaf LLC Workshop Food and COVID Liability

SECTION 1 - FOOD CONSUMPTION AND ALLERGIES

1.1. Tumbler Workshop, Banana Leaf LLC and all of its volunteers make every attempt to identify all allergen-containing ingredients in each dish. However, there is always a risk of contamination. If you are concerned with food allergies, you need to be aware of this risk. Banana Leaf LLC all of its volunteers during the workshop will not assume any liability for adverse reactions to food consumed.

1.2. Customers and attendees of the Tumbler Workshop along
with the creators of the Tumbler Workshop shall release Banana Leaf
LLC, its owners, investors, employees and volunteers from all claims, damages and causes of action or liabilities which may arise as a result of the preparation, storage and consumption of the Tumbler Workshop meals, snacks and beverages.

1.3. All meals and sides will be made on site with the help of the
attendees without power. A sanitation station will be provided with sanitation wipes and liquid sanitizer. There will also be a working sink for proper
hand washing from all attendees, workers and volunteers.

1.4. Food, snacks and beverages will be store bought and brought to the site
on the day of the workshop October 1st, 2022. Tumbler Workshop,
Banana Leaf LLC and all of its volunteers make every attempt to identify all ingredients in each snack and beverage.

SECTION 2 - MISCELLANEOUS TERMS

2.1. We do not guarantee, represent or warrant that your use of our
service will be uninterrupted, timely, secure or error-free.

2.2. You agree that from time to time we may remove the service for
indefinite periods of time or cancel the service at any time, without notice to
you.

2.3. You expressly agree that your use of, or inability to use, the service
is at your sole risk. The service, all products and services delivered to you
through the Tumbler Workshop are (except as expressly stated by
us) provided 'as is' and 'as available' for your use, without any representation,
warranties or conditions of any kind, either express or implied, including all
implied warranties or conditions of merchantability, merchantable quality,
fitness for a particular purpose, durability, title, and non-infringement.

2.4. In no case shall the Tumbler Workshop, Banana Leaf
LLC and all of its volunteers, affiliates, suppliers, service
providers or licensors be liable for any injury, loss, claim, or any direct,
indirect, incidental, punitive, special, or consequential damages of any kind,
including, without limitation lost profits, lost revenue, lost savings, loss of data,
replacement costs, or any similar damages, whether based in contract, tort,
strict liability or otherwise, arising from your use of any of the service or any
products procured using the service, or for any other claim related in any way
to your use of the service or any product, including, but not limited to, any
errors or omissions in any content, or any loss or damage of any kind incurred
as a result of the use of the service or any content (or product) posted,
transmitted, or otherwise made available via the service, even if advised of
their possibility.

2.5. You agree to indemnify, defend and hold harmless the Tumbler Workshop, Banana Leaf LLC and all of its volunteers, affiliates, suppliers, service providers or licensors, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

2.6. In the event that any provision of these Terms of Service is
determined to be unlawful, void or unenforceable, such provision shall
nonetheless be enforceable to the fullest extent permitted by applicable law,
and the unenforceable portion shall be deemed to be severed from these
Terms of Service, such determination shall not affect the validity and
enforceability of any other remaining provisions.

2.7. These Terms of Service are effective unless and until terminated by
either you or us. You may terminate these Terms of Service at any time by
notifying us that you no longer wish to use our Services, or when you cease
attending the Tumbler Workshop. If in our sole judgment you fail, or
we suspect that you have failed, to comply with any term or provision of these
Terms of Service, we also may terminate this agreement at any time without
notice and you will remain liable for all amounts due up to and including the
date of termination; and/or accordingly may deny you access to our Services
(or any part thereof).

2.8. The obligations and liabilities of the parties incurred prior to the
termination date shall survive the termination of this agreement for all
purposes.

2.9. The failure of us to exercise or enforce any right or provision of
these Terms of Service shall not constitute a waiver of such right or provision.

2.10. These Terms of Service and any policies or operating rules posted
by us on this form or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of
the Service, superseding any prior or contemporaneous agreements,
communications and proposals, whether oral or written, between you and us
(including, but not limited to, any prior versions of the Terms of Service).

2.11. These Terms of Service and any separate agreements whereby
we provide you Services shall be governed by and construed in accordance
with the laws of Washington state.

2.12. You can review the most current version of the Terms of Service at
any time on this form. However, we reserve the right, at our sole discretion, to
update, change or replace any part of these Terms of Service by posting
updates and changes to our websites. It is your responsibility to check our
website periodically for changes. Your continued use of or access to our
website or the Service following the posting of any changes to these Terms of
Service constitutes acceptance of those changes.

COVID-19 Safety Acknowledgment -- Liability Waiver and Release of
Claims

COVID-19 SAFETY INFORMATION:

While participating in events held or sponsored by Tumbler
Workshop, Banana Leaf LLC and all of its volunteers, consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and wear face coverings when needed to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, the Tumbler Workshop has put in place preventative measures to reduce the spread of COVID-19. However the Tumbler  Workshop cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.

In light of the ongoing spread of COVID-19, individuals who fall within any of
the categories below should not engage in Chasing Sunsets Workshop events
and/or other face to face fundraising activities. By attending the Tumbler Workshop event, you certify that you do not fall into any of the
following categories:
1. Individuals who currently or within the past fourteen (14) days have
experienced any symptoms associated with COVID-19, which include fever,
cough, and shortness of breath among others;
2. Individuals who have traveled at any point in the past fourteen (14) days
either internationally or to a community in the U.S. that has experienced or is
experiencing sustained community spread of COVID-19; or
3. Individuals who believe that they may have been exposed to a confirmed or
suspected case of COVID-19 or have been diagnosed with COVID-19 and are
not yet cleared as non-contagious by state or local public health authorities or
the health care team responsible for their treatment.

DUTY TO SELF-MONITOR:

Participants and volunteers agree to self-monitor for signs and symptoms of
COVID-19 (symptoms typically include fever, cough, and shortness of breath)
and, contact Tumbler Workshop, Banana Leaf LLC at bananaleaftumblers@gmai.com if he/she
experiences symptoms of COVID-19 within 14 days after participating or
volunteering a the Tumbler Workshop.

LIABILITY WAIVER AND RELEASE OF CLAIMS:

I acknowledge that I derive personal satisfaction and a benefit by virtue of my
participation and/or voluntarism with the Tumbler Workshop, and I
willingly engage with the Tumbler Workshop events and/or other
fundraising activities (the “Activity”).

RELEASE AND WAIVER

I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL
LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE
AGAINST THE AMERICAN CANCER SOCIETY AND ITS AFFILIATED
PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT
LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES,
VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN
LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW,
INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY
THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART
OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH,
BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET
EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS,
ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR
DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY
HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY
HEREAFTER ARISE FROM MY PARTICIPATION WITH THE ACTIVITY.

ASSUMPTION OF THE RISK

I acknowledge and understand the following:
1. Participation includes possible exposure to and illness from infectious
diseases including but not limited to COVID-19. While particular rules and
personal discipline may reduce this risk, the risk of serious illness and death
does exist;
2. I knowingly and freely assume all such risks related to illness and infectious
diseases, such as COVID-19, even if arising from the negligence or fault of
the Released Parties; and
3. I hereby knowingly assume the risk of injury, harm and loss associated with
the Activity, including any injury, harm and loss caused by the negligence, fault
or conduct of any kind on the part of the Released Parties.

MEDICAL ACKNOWLEDGMENT AND RELEASE

I acknowledge the health risks associated with the Activity, including but not
limited to transient dizziness, lightheadedness, fainting, nausea, muscle
cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack,
stroke, or sudden death. I agree that if I experience any of these or any other
symptoms during the Activity, I will discontinue my participation immediately
and seek appropriate medical attention. I DO HEREBY RELEASE AND
FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY CLAIM
WHATSOEVER WHICH ARISES OR MAY HEREAFTER ARISE ON
ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN
CONNECTION WITH MY PARTICIPATION IN THE ACTIVITY.
As a participant, volunteer, or attendee, You recognize that your participation,
involvement and/or attendance at any Banana Leaf LLC
event or activity (“Activity”) is voluntary and may result in personal injury
(including death) and/or property damage. By attending, observing or
participating in the Activity, You acknowledge and assume all risks and
dangers associated with your participation and/or attendance at the Activity,
and You agree that: (a) Banana Leaf LLC (b) the property or
site owner of the Activity, and (c) all past, present and future affiliates,
successors, assigns, employees, volunteers, vendors, partners, directors, and
officers, of such entities (subsections (a) through (c), collectively, the
"Released Parties"), will not be responsible for any personal injury (including
death), property damage, or other loss suffered as a result of your
participation in, attendance at, and/or observation of the Activity, regardless if
any such injuries or losses are caused by the negligence of any of the
Released Parties (collectively, the "Released Claims"). BY ATTENDING
AND/OR PARTICIPATING IN THE ACTIVITY, YOU ARE DEEMED TO HAVE
GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO
THE FULLEST EXTENT PERMITTED BY LAW.
